If you believe a civil decision is incorrect or unfair, you may be able to appeal.

When you can appeal

You may appeal a decision within a reasonable time after it is made.

An appeal must clearly explain:

  • the grounds for the appeal
  • any error or unfairness in the original decision

How to file an appeal

To file an appeal:

  1. prepare a statement of your grounds
  2. identify the decision you are appealing
  3. submit your appeal through the Court’s system

The Court will arrange for the appeal to be heard, usually by a different Judge.

What happens next

The appeal authority may:

  • uphold the original decision
  • overturn the decision
  • modify the decision
  • order a new hearing

For more information on decisions, see ‘Understanding court judgements and orders’.

Additional information

  • Appeals must follow Court procedures
  • Final decisions may be made by higher authority
