An Act to establish and define the processes of the temporary Koru’s Court to handle civil and criminal hearings.

ENACTED by the Koru of the Hokorian State through constitutional order as an Additional Provision under the Constitution of the Hokorian State.

Part I- Preliminary

Section 1- Short Title

  1. This Act may be cited as the Koru’s Court Act, 2025.

Section 2- Commencement

  1. This Act shall come into force on a date appointed by the Koru of the Hokorian State.

Section 3- Interpretation

  1. “State” means the Hokorian State;
  2. “Court” means the Koru’s Court established under this Act;
  3. “Koru” means the Koru of the Hokorian State;
  4. “Presiding Judge” means a person appointed under Section 6 of this Act;
  5. “Civil matter” means a dispute between persons concerning rights, obligations or property;
  6. “Criminal matter” means a case in which a person is alleged to have committed an offence against the laws of the State.

Part II- Establishment and Authority

Section 4- Establishment of the Court

  1. The Koru’s Court shall be established as a court, operating under the direct authority of the Koru of the Hokorian State.
  2. The Court shall sit at such times and places as the Koru may direct.

Section 5- Authority of the Court

  1. The Court shall derive its judicial authority from the Koru of the Hokorian State.
  2. The Court shall act in the name of the Koru of the Hokorian State and shall uphold the sovereignty of the State, the supremacy of the Constitution, and the dignity of the Koru.

Section 6- Appointment of a Presiding Judge

  1. The Koru may preside over the Court personally or appoint a Presiding Judge to act on their behalf.
  2. A Presiding Judge shall hold office at the will of the Koru.
  3. The Koru may appoint deputies or assistants to the Presiding Judge for the conduct of hearings.

Part III- Jurisdiction and Powers

Section 7- Civil Jurisdiction

  1. The Court shall have jurisdiction to hear and determine civil matters of any value or subject matter.
  2. The Court may make orders for payment, restitution, injunctions and other remedies as it deems just.

Section 8- Criminal Jurisdiction

  1. The Court shall have jurisdiction to hear and determine all criminal matters.
  2. The Court may impose fines, community service, detention, banishment or other lawful penalties.

Section 9- General Powers

  1. The Court may issue summonses, warrants and orders necessary for the fair determination of matters.
  2. The Court may adopt such procedures as it considers appropriate for the expeditious resolution of cases, provided they are consistent with the Constitution and this Act.

Part IV- Procedure

Section 10- Commencement of Proceedings

  1. Civil proceedings may be commenced by written application to the Court Clerk.
  2. Criminal proceedings may be commenced by the filing of a charge sheet by a law enforcement officer, the Ministry of Justice and Enforcement, or the Koru’s Office.

Section 11- Hearings

  1. Hearings shall be conducted by the Koru or Presiding Judge.
  2. Parties shall be given the opportunity to present evidence and submissions.
  3. The Court may receive oral or written evidence and shall not be bound by technical rules of evidence.

Section 12- Judgments and Orders

  1. Judgments shall be delivered orally or in writing and shall take effect immediately unless otherwise specified.
  2. Orders of the Court shall be enforceable throughout the State.

Part V- Administration and Records

Section 13- Court Clerk

  1. The Koru may appoint a Court Clerk to assist in the administration of the Court.
  2. The Court Clerk shall maintain records, schedule hearings and perform other duties as directed by the Koru or Presiding Judge.

Section 14- Record Keeping

  1. The Court shall keep a record of each case, including the names of the parties, the nature of the matter, the decision and any orders made.
  2. Records shall be maintained by the Koru’s Office and may be made public at the Koru’s discretion.

Section 15- Appeals

  1. Decisions of the Court shall be final, except that the Koru may, at their own will, review and amend any decision.

Part VI- Dissolution

Section 16- Dissolution of the Court

  1. The Court may be dissolved on a date appointed by the Koru.
  2. Upon dissolution, all pending matters shall be transferred to such court or tribunal as the Koru may direct.

Part VII- Miscellaneous

Section 17- Immunity

  1. No action shall lie against the Koru, Presiding Judge, Court Clerk or any person acting under their authority for acts done in good faith in the exercise of powers under this Act.

Section 18- Regulations

  1. The Koru may make regulations to give effect to this Act.
