Who can file an accusation

An authorised official is responsible for filing a criminal accusation and acting as the prosecutor.

Members of the public cannot directly bring a criminal case.

What the accusation must include

The accusation must:

  • identify the defendant
  • clearly state the alleged offence
  • include a summary of the evidence

How an accusation is filed

The authorised official submits the accusation to the Court.

The Court will then:

  • notify the defendant
  • arrange an initial hearing
