A person involved in a criminal case may appeal a decision if they believe it is incorrect or unfair.
When you can appeal
An appeal must be made within a reasonable time.
You must clearly state:
- the grounds of appeal
- the alleged error or unfairness
How to file an appeal
To file an appeal:
- prepare a statement of your grounds
- identify the decision you are appealing
- submit the appeal through the Court system
The appeal will normally be heard by a different Judge.

The appeal authority may:
- uphold the decision
- overturn the decision
- modify the outcome
- order a new hearing
