A person involved in a criminal case may appeal a decision if they believe it is incorrect or unfair.

When you can appeal

An appeal must be made within a reasonable time.

You must clearly state:

  • the grounds of appeal
  • the alleged error or unfairness

How to file an appeal

To file an appeal:

  1. prepare a statement of your grounds
  2. identify the decision you are appealing
  3. submit the appeal through the Court system

The appeal will normally be heard by a different Judge.

What happens next

The appeal authority may:

  • uphold the decision
  • overturn the decision
  • modify the outcome
  • order a new hearing
